Hoge Fenton Attorney Provides Statement on Prosecution Decision in De Anza Rape Case

Barbara Spector, attorney with Hoge Fenton Jones & Appel, released the following statement today regarding California Attorney General Jerry Brown's announcement regarding the De Anza Rape Case:

Following the Attorney General's confirmation of the District Attorney's decision not to file criminal charges in the De Anza Rape Case, there have been many requests for the victim's reaction to that decision.

As her attorneys in the civil lawsuit, we believe the public is sensitive to the fact that it is our intention to protect our client's privacy and to maximize the opportunity for the successful prosecution of the defendants in this matter.

We are aware that the public has been waiting for fourteen months for answers and that the Attorney General reported that many of the men questioned during the criminal investigation refused to talk; however, the facts surrounding the event will be developed and made public during the course of civil legal proceedings.


Attny. General To Attend Richmond DNA Lab Opening

California Attorney General Jerry Brown is scheduled to attend a ceremony at the state's DNA laboratory in Richmond Monday to mark the completion of a $10 million expansion of the facility. The laboratory and storage facility underwent a 28,000-foot expansion to prepare the state to collect a growing number of DNA samples required by Proposition 69, according to the attorney general's office. The proposition, which was approved by voters in 2004, requires that the state start collecting DNA samples from every felony arrestee beginning Jan. 1, 2009. The state's DNA database hosts more than 1 million DNA profiles and the expansion aims to accommodate more than 2 million samples expected over the next 5 years due to the proposition, according to the attorney general's office. Bruce Harrington, a sponsor of the proposition, will join Brown at the ceremony at the Jan Bashinski DNA Laboratory, 1001 W.


State declines to file charges in De Anza College rape case

California Attorney General Jerry Brown says his office will not file charges against De Anza College baseball players who were accused of raping a 17-year-old girl last year at a house party.

The Santa Clara County District Attorney made the same decision last year, prompting a public outcry and Brown's involvement.

Brown announced his decision today at a news conference in San Francisco.

Authorities began investigating athletes and other students at the community college in Cupertino after the teenager claimed she was gang-raped at a birthday party for one of the players.

Eight players were suspended from the team after the alleged rape was reported.

Former district attorney Daly dies

William Crawford Daly, a former Fresno County district attorney and deputy public defender, died Wednesday after a battle with cancer. He was 78.Mr. Daly was elected district attorney in 1968 and served until June 1973. He resigned under pressure after he was investigated by the California Attorney General's Office for possible criminal misconduct. No charges were filed.While district attorney, Mr. Daly led a campaign to rid county theaters of pornographic movies and books, though the effort resulted in few convictions. He later became a private attorney and joined the Fresno County Public Defender's Office in 1978 to handle major criminal cases. He left the public defender's office about a decade later, said his granddaughter, Meghan Wilson. Mr. Daly's son, David Daly, said Thursday that his father was involved in the First Congregational Church near Fresno City College.
